Terms of Use
These Terms of Use govern your access to and use of Conexity services. We may update them from time to time; we will provide at least 14 days notice of material changes before they take effect. Continued use of the services after that period constitutes acceptance of the updated terms.
1. Acceptance
These Terms of Use ("Terms") form a binding agreement between you and Conexity Pty Ltd ("Conexity", "we", "us") and govern your access to and use of our website, broker portal, AI-assisted voice qualification, appointment booking, CRM features, referral programs, and related services (the "Services"). By accessing or using the Services you agree to these Terms.
2. Eligibility and accounts
The Services are intended for Australian mortgage brokers, related service operators, and consumers seeking to be connected to a broker. You must provide accurate information and keep your account credentials confidential. You are responsible for all activity on your account.
3. Subscription, pricing, and billing
Subscription fees, add-on pricing, and any usage-based charges are set out at the point of sale or in your order confirmation. All prices are quoted in Australian dollars and exclude GST unless explicitly stated; GST is added at checkout or on invoice where applicable. Annual billing is prepaid for the full term; monthly billing renews on the same calendar day each month until cancelled in line with the Refund Policy.
4. Service description and limits
The Services include an AI voice qualification agent, lead routing infrastructure, broker workflow tools, and referral payout administration. Service performance depends on third-party providers (telephony, AI model inference, cloud hosting, calendaring) and your own configuration of integrations.
5. No guarantee of outcomes
You acknowledge and accept that:
- AI voice qualification, appointment generation, and lead outcomes are not guaranteed beyond the specific service terms stated in your subscription plan.
- Lead volume, conversion rate, appointment show-up rate, and commercial returns vary by territory, market conditions, broker availability, and consumer behaviour, and are outside Conexity's direct control.
- Where Conexity publishes example figures, benchmarks, or projections (including referral payout calculators or ROI illustrations), these are illustrative only and do not constitute a forecast, warranty, or representation of future results.
- AI systems can make mistakes, including misclassification, mis-transcription, or scheduling errors; you remain responsible for verifying material information before acting on it.
6. Acceptable use
You must not use the Services to:
- Breach any law, regulation, or licensing obligation applicable to credit assistance or financial services in Australia.
- Send unsolicited marketing in breach of the Spam Act 2003 or Do Not Call Register Act 2006.
- Upload or process personal information for which you do not have lawful authority.
- Reverse engineer, scrape, or otherwise interfere with the integrity of the Services.
7. Intellectual property
Conexity retains all rights, title, and interest in the Services, including the underlying software, AI prompts, training, scripts, models, and brand. You retain your own data. You grant Conexity a non-exclusive licence to process your data solely to provide the Services.
8. Confidentiality
Each party will keep confidential information of the other party confidential and only use it for the purpose of performing under these Terms.
9. Liability
To the maximum extent permitted by law, Conexity's total aggregate liability arising out of or in connection with the Services is limited to the fees paid by you in the three (3) months immediately preceding the event giving rise to the claim. Conexity is not liable for any indirect, consequential, or special loss, including loss of profits, business opportunity, or reputation. Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot lawfully be excluded.
10. Termination
Either party may terminate for material breach not remedied within fourteen (14) days of written notice. Conexity may suspend or terminate access immediately where it reasonably believes there is a risk to its platform, other customers, or compliance obligations.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the exclusive jurisdiction of the courts of New South Wales.
